DIÁRIO DA CAMARÁ

Sua Maçrslade a RAINHA do Portugal , ao [II.m° e Ex.mo Sr. João Baptista de Almeida Garrei, seu Chronisln Mor, e do seu Concelho, Deputado da Nação Porlugueza, Cavalleiro da Antiga e Muito Nobre Ordem'du Torre e Espada do Valor Lealdade e Mérito, Commenda-dor da Ordem de Chnsto, Official da de Leopoldo na Bélgica, Juiz do Tribunal Superior do Commercio, Enviado Extraordinário e Mi-nistro Plenipotenciário junto a Sua Mageslade Calliolica.

E o Presidente dos Eslados-Unidos da America ao Sr. Eduardo Ra-vanagh, Encarregado dos Negócios dos mesmos Estados nesta Corte.

Os quaes, depois de terem communicado um ao outro os seus respectivos Plenos Poderes, que se acharam em boa e devida forma, .ajustaram c concluíram os Artigos seguintes:

ARTIGO 1.°

Haverá entre os Territórios das Altas Partes Conlractanles reciproca liberdade de Commercio e Navegação.

Os súbditos e Cidadãos dos seus respectivos Estados poderão mutua e livremente entrar nos Portos, Logares e Rios dos Territórios de cada uma das ditas Partes Contractantes, aonde quer que o Commercio Estrangeiro e' ou vier a ser perniillido. Terão igualmente liberdade de pousar e residir em qualquer parte dos ditos Territórios, a fim de tra-ctar de seus negócios; e gosarào, para esse fim, a mesma segurança e protecção que os naturaes do Paiz onde residem , sob condição de se sujeitarem as Leis e Ordens do Governo que ahi regelem, especialmente aos Regulamentos Comrnerciaes em vigor.

ARTIGO 2.°

Os Navios Porluguezes que aportarem, carregados ou em lastro, nos portos dos Estados-Unidos da America, e reciprocamente oi Navios dos Estados-Unidos da America que aportaram, carregados ou em las-Iro aos Portos do Reino e Possessoens de Portugal, serão tractados, ií entrada ,-durante a sua estada no Porto, e á snhida delle , do m usino modo que os Navios Nacionaes vindos de iguaes procedências, em relação aos direitos de tonelagem , de faroes, pilotagem e ancoradouro, e bem assim quanto nos emolumentos e propinas das Autlioridades Publicas, ou a quaesquer outros encargos e direitos, de qualquer natureza ou denominação que sejam , e que costumara levar-se aos Navios de Commercio, ou soja por conla do Governo, das Aullioridades locaes, ou de qualquer outro Estabelecimento Publico ou Particular.

ARTIGO 3.°

Não se imporão outros nem maiores direitos, na importação em os Eslados-Unidos da America, de género algum que seja producto na-lurai ou de manufactura do Reino de Portugal e suas Possessões, nem outros ou maiores direitos aerão impostos na importação, ern o Reino de Portugal e suas Possessões, de nenhum gonero de producção natural ou de manufactura dos Eslados-Unidos da America além daquelles que pagam, ou vieremáa pagar, iguaus géneros de producção natural ou de manufactura de^^íalquer outro Paiz Estrangeiro.

iSem se estabelecerá prohibição alguma na importação ou exportação de qualquer género de producção natural, ou manufactura do Reino de Portugal e suas Possessões, ou dos Eslados-LInidos da America, respectivamente em algum delles, que do mesmo rnodo se não estabeleça igualmente para todas as outras Nações Estrangeiras.

Nem se estabelecerão outros, ou muiortjs direitos ou encargos, cm qualquer dos dous Paizes , sobre a exportação de quaesquer géneros para os Estados-Unidos da America, ou para o Reino de Portugal respectivamente, além dos que se pagam pela exportação de iguaes géneros para outro Paiz Estrangeiro.

Entendendo-se todavia que nada do que neste Artigo se conte'm, poderá prejudicar a estipulação aduiitlida pelos Estados-Unido» da Américo, por um equivalente

Pagar-se-hâo os mesmos direitos, e serão concedidos os mesmos fa-vore?, dcducções ou privilégios pela importação em os E&tados-Unidos da America, de qualquer género de producção natural, ou manufactura de Portugal, c suas Possessões, quer a dila importação seja feita cm Navios Porluguezes, ou em Navios dos ditos Estados : e reciprocamente se pagarão os me&rnos direitos, e serão concedidas os mesmos favores de-ducções e privilégios pela importação em o Reino c Possessões de Portugal , de qualquer género do producção natural, ou manufactura dos Estados-Unidos d'America, quer a dita importação se faça em Navios dos ditos Estados, ou ern Navios Poiluguezcs.

ARTIGO 5.°

Convierarn as nltas Parles Contraclantes, que se em algum tempo fôr permittido o importar em todos ou alguns dos Portos do Reino e Possessões de Portugal, em Navios de qualquer Nação Estrangeira algum género de producção natural, ou manufactura de outro Paiz que não seja aquelle a que os ditos Navios pertencerem ; o mesmo favor será immedialamentc extensivo aos Navios dos Estados-Unidos d'Ame-rica com os mesmos direitos e favores que furem , para esse fim, concedidos á Nação mais favorecida. Ern consideração do que, e reciprocamente, os Navios Portuguezes gosarão d'ahi em diante, e para o mesmo fim, privilégios, direitos e favores na mesma extensão correspondente nos Portos dos Eslados-Unidos d'Atnerica.

ARTIGO 6.°

Toda a sorte de mercadorias e artigos de commercio, que legalmente podem ser exportados ou re-exportados dos Portos de uma das Altas Partes Conlractanles para qualquer Pai?, Estrangeiro em Navios Nacio-naeg, poderão igualmente ser exportados ou reexportados dos ditos Pôr-los, em os Navios da outra Parle respectivamente, sem pagar outros ou maiores direitos, ou encurgoí de qualquer modo ou denominação que srjam, do que se as ditas mercadorias, ou artigos de cofnmercio fossem exporindos ou reexportados em Navios Nacionaes.

E Conceder»se-hão os mesmos f.ivores, e deducçòes de direitos, quer a exportação ou re-expotlação Sfja feka em Navios de uma ou de outra das das ditas Partes.

AHTICLH 3.«l

No higher or olher dulics shall be imposedon lho imporlation into the Uniled Slates of America, of any arlicle, lhe growlli, produceor manufacture ofPorlugal and Her Pobse&sions; and rio higher or olher duties shall be imposed ou lhe irnportation inlo lhe Kingdom and Possession of Portugal, of any arlicle, tht-growlh, produce or manufacture of lhe Uniled States of America, lhan such as are, or shall be, payable on the like article being the grosvlh, produce or manufacture of any olher foreign Country.

Nor shall any prohibilion be imposed on the importalion of any article , the ^rowlh, produce or manufacture of lhe Kingdom and Possession ofPorlugal, or of lhe United States of America, to or from the porls of lhe said States, or of lhe said Kingdom, and Possessions of Portugal, which shall not equally exlend lo ali other Foreign Nalions.

Nor shall any higher or olher dulies or charges be imposed, in either of the two Counlries, on the exportalions of any arlicle lo the United Slalcs of America, or to the Kingdom of Portugal, respeclively, lhan such ns are payable on llie exportalion of the like articles lo any olhar foreign Country.

Provided, however, that nothing contained in the arlicle shall be un-derslood, or intendt-d, to interfere w i th lhe stipulation cnlt-red into by lhe United States ot'America, for a special equivalení, in regard to Frendi wines in the Convention made by lhe said States and France,on the fourlh. day of July in the year of Our Lord One thousand eight hundred and thirtyone; which slipulations will expire and cease to IjavceíTecl in thu monih ofFebruary, in lhe year of Our Lord One thousand eighl hundred and forly t\vo.

AKTICLE 4.th

The same duties shall be paid, and lhe same bounlies, deduclions or privileges ullowed on lhe itnporialion, inlo lhe Uniled States of America, of any article, thcgrowlh, produce or manufacture of Portugal, nnd Her Possessions, whether suei» imporlation shall bein Poi luguese Viésseis, or in Verseis or' lhe said States: and rociprocally lhe satne dulies shall be paid, and the sam« bounties, deduclions or privik-ges nllowed on lhe imporlation inlo lhe Kingdom and Posiessiuns ofPorlugal, of any arlicle, the growth, produce or manufacture of the United States of America, whether such importalion shall be in Vessels of the said States or in Portuguc-se Vessclá.

ARTICLE 5.th

It is agreed by the High Contracling Parties, lliat whenever there may be lawfully impoiíed inlo ali, or any, of lhe porls of the Kingdom and Possessions ofPorlugal, in Vess>eU of »ny foreign Counlry, articles of the growth, pn.d icu or rnanufacture of a Co-unirv Colher than tljat to which lhe ir.iporiing Vessels shall belong, the same privileges shall immediately becornc common to Vossels of the Uniled States of America, wilh ali lhe same-ríghts and favours as may in that respecl be gran-ted to the most favoured Nalion. And reciprocally , Portugnese Ves-sels shall lhereafter enjoy in the same rcspect, privileges, rights, and fuvours , to a correspoudenl exlent, in lhe porta of lhe United States of America.

AM kind of merchandise and articles of Cormrerce which may be lawfully exporled orreexporlcd from lhe porta ofeilher of lhe High Con-tracting Pnrlies to any foreign Country, in National Viseis, may also be exporled or ree\poiled lherefrom, in Vessels of the Olher Parly, respectively, wilhoul paying olher or higher dulies or charges, o f \vha-levor kind or denominulion lhan if lhe same marchandiso or articles of Coinuierce were exporled or reexporled m National Vessels.
