Portugal e dos Algarves, e Sua Magestade a Rainha do Reino Unido da Gran-Bretanha e Irlanda, para a suppressão do tratado da escravatura, e nos annexos A, B, C, respectivos, com referencia ao estabelecimento das commissões mixtas para ouvirem e decidirem em todos os casos de apresamento de embarcações que possam ser trazidas á sua presença por se haverem empregado em transportar negros com o fim de os reduzir á escravidão ou por terem sido esquipadas n'esse intento, bem como á organisação, jurisdicção, e fórma de processo de taes commissões mixtas, cessará e terminará pelo que respeita ás ditas commissões mixtas, desde e depois da troca das ratificações da presente convenção addicional, excepto só no que respeitar a qualquer acto ou procedimento que d'aquellas dimane, feito ou tomado antes d'esta convenção addicional ser officialmente communicada ás referidas commissões mixtas, ou aos officiaes commandantes dos cruzadores portuguezes ou britannicos empregados em prevenir o trafico da escravatura, e que se acharem munidos com as instrucções que formam o annexo A ao tratado de 3 de julho de 1842.

Artigo 2.°

A jurisdicção até agora exercida pelas ditas commissões mixtas em virtude das estipulações do dito tratado, serão, depois da troca das ratificações da presente convenção addicional, exercidas pelos tribunaes das altas partes contratantes em conformidade com suas respectivas fórmas de processo em casos de trafico de escravatura; e todas as estipulações do dito tratado com referencia a remetter ou trazer embarcações apresadas para julgamento perante as ditas commissões mixtas, e com respeito ao julgamento de taes embarcações pelas ditas commissões mixtas, e as regras da prova a applicar, e os procedimentos inherentes a taes julgamentos, serão applicaveis, mutatis mutandis, aos tribunaes das altas partes contratantes.

Fica porém estipulado que possa haver appellação das decisões de qualquer tribunal das altas partes contratantes, de modo que a lei do paiz, onde este tribunal funccionar, o permittir em outros casos de escravatura.

Artigo 3.°

Fica estipulado que no caso de uma embarcação portugueza visitada por cruzador britannico ser detida por haver sido empregada no trafico da escravatura, ou por haver sido esquipada com esse fim, essa embarcação será enviada para julgamento á colonia portugueza mais proxima ou mais accessivel, ou será entregue a cruzador portuguez, se algum se encontrar na vizinhança do apresamento que possa servir; e que no caso identico de uma embarcação britannica vizitada por cruzador portuguez ser detida por haver sido empregada no trafico da escravatura, ou esquipada com esse fim, tal embarcação será mandada para julgamento á colonia britannica mais proxima ou mais accessivel, ou será entregue a cruzador inglez, no caso de algum se encontrar na vizinhança do apresamento que possa servir.

Todas as testemunhas e provas necessarias para constituir a criminalidade do mestre, tripulação, ou de outras pessoas encontradas a bordo de tres embarcações, serão mandadas ou entregues com a propria embarcação, a fim de serem levadas ao tribunal ante o qual essas embarcações e pessoas devam ser trazidas.

Todos os negros e outras pessoas (exceptuando as testemunhas necessarias), que possam encontrar-se a bordo de uma embarcação portugueza ou ingleza, destinados a ser reduzidos á escravidão, serão remettidos á auctoridade mais proxima do governo, cujo cruzador tenha effeituado o apresamento. Serão postos immediatamente em liberdade, e ficarão livres, incumbindo ao governo a cuja auctoridade forem entregues garantir-lhes a sua liberdade.

Com relação aos negros ou outros que tenham sido remettidos com as embarcações detidas, como testemunhas necessarias, o governo ao qual tenham sido entregues po-los-ha

Queen of Portugal and the Algarves, and Her Majesty the Queen of the United Kingdom of Great Britain and Ireland, for the suppression of the Traffic in slaves, and in the annexes A, B, C, thereto, which relates to the establishment of mixed Commissions to hear and decide all cases of capture of vessels which may be brought before them, as having been engaged in transporting negroes for the purpose of consigning them to slavery, or as having been fitted out for that purpose, as well as to the composition, jurisdiction, and mode of procedure of such mixed Commissions, shall cease and determine, as regard the said mixed Commissions from and after the exchange of the ratifications of the present additional convention, except in se far as regards any act or proceeding done or taken in virtue thereof before this additional convention shall be officially Communicated to the said mixed Commissions, or to the officers in Command of Portuguese or British cruisers employed to prevent the Traffic in slaves, and furnished with the instructions which form annex A to the Treaty of the 3.d of July, 1842.

Article 2.nd

The jurisdiction heretofore exercised by the said mixed Commissions in pursuance of the provisions of the said Treaty, shall, after the exchange of the ratifications of the present additional convention, be exercised by the courts of the High Contracting Parties according to their respective modes of procedure in cases of slave trading; and all the provisions of the said Treaty with regard to the sending or bringing in of captured vessels for adjudication before the said mixed Commissions, and with, regard to the adjudication of such vessels by the said mixed Commissions, and the rules of evidence to be applied, and the proceedings consequent on such adjudication shfall apply mutatis mutandis to the courts of the High Contracting Parties.

It is however provi ed that there may be an appeal from the decision of any court of the High Contracting Parties, in the same manner as by the law of the country where the court sits, is allowed in other cases of slave trading.

Article 3.d

It is agrend that, in case of a Portuguese vessel visited by a British cruiser being detained as having been engaged in the Traffic in slaves, or as having been fitted out for the purposes thereof, she shall be sent for adjudication to the nearest or most accessible Portuguese Colony, or shall be handed over to a Portuguese cruiser, if one should be available in th neighbourhood of the capture; and that in the corresponding case of a British vessel visited by a Portuguese cruiser being detained as having been engaged in the Traffic in slaves, or as having been fitted out for the purposes thereof she shall be sent for adjudication to the nearest or most accessible British Colony, or shall be handed over to a British cruiser if one shall be available in the neighbourhood of the capture.

All the witnesses and proofs necessary to establish the guilt of the master, crew, or other persons found on board of any such vessels, shall be sent and handed over with the vessel itself, in order to be produced to the court before which such vessel or persons may be brought for trial.

All the negroes or others (necessary witnesses excepted), who may be on board a Portuguese or a British vessel for the purpose of being consigned to slavery shall be handed over to the nearest authority of the Government whose cruiser has made the capture. They shall be immediately set at liberty, and shall remain free, the Government to whose authority they may be delivered guaranteeing their liberty.

With regard to such of those negroes or others as may be sent in with the detained vessels as necessary witnesses, the Government to which they have been delivered shall
