viado extraordinario e ministro plenipotenciario junto a Sua Magestade Britannica;

E Sua Magestade a Rainha do Reino Unido da Gran-Bretanha e Irlanda ao muito honrado Jorge Granville, conde de Granville, lord Leveason, par do Reino Unido, cavalleiro da nobilissima ordem da Jarreteira, membro do conselho privado de Sua Magestade, lord guarda dos cinco portos, governador do castello de Dover, chanceller da universidade de Londres, seu principal secretario d'estado dos negocios estrangeiros; os quaes tendo communicado um ao outro os seus plenos poderes, que acharam estar em boa e devida fórma, convencionaram e concluiram os artigos seguintes:

Artigo I

Tudo quanto se contem no tratado concluido em Lisboa aos 3 de julho de 1842 entre Sua Magestade a Rainha de Portugal e dos Algarves e Sua Magestade a Rainha do Reino Unido da Gran-Bretanha e Irlanda, para a suppressão do trafico da escravatura, e nos annexos A, B, C, respectivos, com referencia ao estabelecimento das commissões mixtas para ouvirem e decidirem em todos os casos de apresamento de embarcações que possam ser trazidas á sua presença por se haverem empregado em transportar negros, com o fim de os reduzir á escravidão, ou por terem sido esquipadas n'esse intento, bem como á organisação, jurisdicção e fórma de processo de taes commissões mixtas, cessará e terminará pelo que respeita ás ditas commissões mixtas, desde e depois da troca das ratificações da presente convenção addicional, excepto só no que respeitar a qualquer acto ou procedimento que d'aquellas dimane feito ou tomado antes d'esta convenção addicional ser officialmente communicada ás referidas commissões mixtas, ou aos officiaes commandantes dos cruzadores portuguezes ou britannicos empregados em prevenir o trafico da escravatura, e que se acharem munidos com as instrucções que formam o annexo A ao tratado de 3 de julho de 1842.

Artigo II

A jurisdicção até agora exercida pelas ditas commissões mistas em virtude das estipulações do dito tratado, serão, depois da troca das ratificações da presente convenção addicional, exercidas pelos tribunaes das altas partes contratantes em conformidade com suas respectivas fórmas de processo em casos de trafico de escravatura; e todas as estipulações do dito tratado com referencia a remetter ou trazer embarcações apresadas para julgamento, perante as ditas commissões mixtas, e com respeito ao julgamento de taes embarcações pelas ditas commissões mixtas, e as regras da prova a applicar, e os procedimentos inherentes a taes julgamentos, serão applicaveis, mutatis mutandis, aos tribunaes das altas partes contratantes.

Fica porém estipulado que possa haver appellação das decisões de qualquer tribunal das altas partes contratantes, do modo que a lei do paiz onde esse tribunal funccionar o permittir em outros casos de escravatura.

Artigo III

Fica estipulado que no caso de uma embarcação portugueza visitada por cruzador britannico ser detida por haver sido empregada no trafico da escravatura, ou por haver sido esquipada com esse fim, essa embarcação será enviada para julgamento á colonia portugueza mais proxima ou mais acceesivel, ou será entregue a cruzador portuguez, se algum se encontrar na vizinhança do apresamento que possa servir, e que no caso identico de uma embarcação britannica visitada por cruzador portuguez ser detida por haver sido empregada no trafico da escravatura, ou esquipada com esse fim, tal embarcação será mandada para julgamento á colonia britannica mais proxima ou mais accessivel, ou será
their Britannic, Most Faithful, and Catholic Majesties, etc., etc., etc., Minister and Honorary Secretary of State, and His Envoy Extraordinary and Minister Plenipotentiaty at the court of her Britannic Majesty;

And Her Majesty the Queen of the United Kingdom of Great-Britain and Ireland, the Right Honorable Granville, Genrge, Earl Granville, Lord Levesson, a Peer of the United Kiogdom, Knight of the Most Noble order of the Garter, a member of Her Majesty's Privy Council, Lord Warden of the Cinque Ports, and Constable of Dover Castle, Chancellor of the University of London, Her Majesty's Principal Secretary of State for Foreign Affairs; who, after having communicated to each other their respective Full Powers found in good and due form, have agreed upon and concluded the following articles.

Article I

Every thing contained in the Treaty concluded at Lisbon on the 3.d of July, 1842, between Her Majesty the Queen of Portugal and the Algarves, and Her Majesty the Queen of the United Kingdom of Great Britain and Ireland, for the suppression of the traffic in slaves, and in the annexes A, B, C, thereto, which. relates to the establisment of mixed Commissions, to hear and decide all cases of capture of vessels which may he brought before them, as having been engaged in transporting negroes for the. purpose of consigning them to slavery or as having been fitted our for that purpose, as well as to the composition, jurisdiction, and mode of procedure of such mixed Commissions, shall cease and determine, as regard the said mixed Commissions from and after the exchange of the ratifications of the present additional Convention, except in so far as regards any act or proceeding done or taken in virtue thereof before this additional Convention shall he officially communicated to the said mixed Commissions, or to the officiers in command of Portuguese or British Cruisers employed to prevent the traffic in slaves, and furnished wit the instructions which form annex A to the Treaty of the 3.d of July, 1842.

Article II

The jurisdiction heretofore exercised by the said mixed Commissions in pursuance of the provisions of the said Treaty, shall, after the exchange of the Ratifications of the present additional Convention, he exercised by the courts of the High Contracting Parties according to their respective modes of procedure in cases of slave trading; and al the provisions of the said Treaty with regard to the sending or bringing in of captured vessels for adjudication before the said mixed Commissions, and with regard to the adjudication of such vessels by the said mixed Commissions, and the rules of evidence to be applied, and the proceedings consequent on such adjudication shall apply mutatis mutandis to the courts of the High Contracting Parties.

It is however provided that there may he and appeal from the decision of any court of the High Contracting Parties, in the same manner as by the Law of the Country where the court sits, is allowed in other cases of slave trading.

Article III

It is agreed that, in case of a portuguese vessel visited by a British Cruiser being detained as having been engaged in the traffic in slaves, or as having been fitted out for the purposes thereof, she shall he sent for adjudication to the nearest or most accessible Portuguese Colony, or shall he handed over to a Portuguese Cruiser, if one should he available in the neighbourhood of the capture; and that in the corresponding case of a British vessel visited by a Portuguese Cruiser being detained as having been engaged in the traffic in slaves, or as having been fitted out for the purposes thereof she shall be sent for adjudication to the nearest or most accessible British Colony, or shall be hand-
