O contexto legal decorre do Wildlife and Countryside Act 1981 (versão consolidada), sendo de salientar que

a aplicação da presente legislação, no que às espécies de aves abrangidas diz respeito, resulta da Schedule 2

– Birds which may be killed or taken. Relativamente às tipologias de captura de aves, o contexto legal é definido

pelo Section n.º 5 (Prohibition of certain methods of killing or taking wild birds)7 da Part I (Wildlife) do diploma,

onde se identificam os atos considerados ilegais (Alíneas a) e c) do n.º 1 do Section 5.º 8)9, assim como a

utilização de determinados meios de caça.

De referir, ainda, o Protection of the Birds Act 1954, aplicável às espécies identificadas nos termos do Second

Schedule (Wild birds which may be killed or taken at any time by authorized persons) e do Third Schedule (Wild

birds which may be killed or taken outside the close season). Relativamente às tipologias de captura de aves, o

contexto legal é definido pelo Section 5 (Prohibition of certain methods of kiling wild birds), onde se identificam

os atos considerados ilegais (Alínea a) do n.º 1 do Section 5.º10), assim como os meios de caça para o efeito.

É ainda de mencionar o facto de o contexto legal não proibir o uso de meios de caça conforme o disposto na

alínea c) do n.º 4 do Section 5.º11.

Importa também referir o The Conservation of Habitats and Species Regulations 2017, nomeadamente ao

nível do disposto na Section 45.º (Prohibition of certain methods of capturing or killing wild animals) da Part 3

(Protection of species), sendo que a aplicabilidade decorre do n.º 1 do artigo identificado. Já relativamente à

identificação de meios de captura e de morte de animais selvagens, os mesmos constam do n.º 3 do artigo,

sendo de relevar que os meios identificados são direcionados somente para animais mamíferos.

V. Consultas e contributos

 Consultas facultativas

Poderão ser consultadas as associações do sector, como a FENCAÇA – Federação Nacional das Zonas de

Caça Associativas, Associação Nacional de Proprietários Rurais Gestão Cinegética e Biodiversidade, e a

Sociedade Portuguesa para o Estudo das Aves, entre outras. Poderá, ainda, ser promovida a consulta do

Instituto da Conservação, da Natureza e das Florestas.

As consultas que forem promovidas serão disponibilizadas na página da iniciativa.
