Relatório referente à 4.ª Parte da Sessão Ordinária de 2015 da Assembleia Parlamentar do Conselho

da Europa (APCE), que teve lugar em Estrasburgo de 28 de setembro a 2 de outubro de 2015

A 4.ª Parte da Assembleia Parlamentar do Conselho da Europa (APCE) decorreu em Estrasburgo, de 28 de

setembro a 2 de outubro, com a participação, por parte da Delegação da Assembleia da República, dos

Deputados João Bosco Mota Amaral (PSD), Presidente, António Braga (PS), e Carlos Alberto Gonçalves (PSD).

Sessão Plenária

Da Ordem de Trabalhos (Anexo 1) destacaram-se:

Antes do início dos trabalhos, a Presidente da APCE, Anne Brasseur, propôs que fosse observado um minuto

de silêncio em memória do Deputado da Delegação alemã, Philipp Missfelder, e dos intérpretes da cabine russa,

Dimitri Golybine, e da cabine italiana, Bernardo Ghionda.

No seu discurso de abertura, a Presidente Anne Brasseur, salientou que desde a última Sessão, se tem vindo

a assistir a um agravamento dramático e sem precedentes, da crise dos refugiados, referindo que acontecerá

uma catástrofe, caso os países não trabalhem em conjunto. Chamou a atenção para o facto de se tratar de uma

crise que necessita de uma reação mais ousada, direta e coletiva ao nível paneuropeu e que obriga a ter uma

visão prospetiva e não uma reação após ocorrerem novas situações.

Referiu ainda que a Assembleia Parlamentar se encontra já ativamente empenhada, uma vez que o

fenómeno das migrações e a sua reação ao drama dos refugiados tem sido uma das suas principais atividades

enquanto Presidente. Recordou, no entanto, que os valores dos países membros do Conselho da Europa são

atualmente confrontados com enormes desafios e lançou um apelo premente para que a Assembleia se

mantenha unida face a estes desafios. Neste contexto, deplorou que em certos Estados membros, os defensores

dos direitos do homem e os ativistas da sociedade civil sejam confrontados com toda uma série de problemas –

um quadro jurídico restritivo, procedimentos administrativos complexos e abusivos, pressões, intimidações e

represálias – inaceitáveis numa sociedade democrática e nos Estados membros do Conselho da Europa.

Ao recordar o laureado do prémio Vaclav Havel do ano anterior, Anar Mammaddli, que continua detido no

Azerbaijão, a Presidente Anne Brasseur sublinhou que nos últimos anos a situação dos direitos humanos no

Azerbaijão, tem vindo a deteriorar-se. Considerou que é chegada a hora do Azerbaijão alterar a sua abordagem

relativamente aos direitos do homem e começar a trabalhar seriamente e em profundidade, de modo a corrigir

os problemas sistémicos no funcionamento da justiça, no respeito da liberdade dos mídia e da liberdade de

associação e de reunião.

Após quase dois anos na Presidência da Assembleia Parlamentar do Conselho da Europa, a Presidente

Anne Brasseur, teceu um balanço pouco satisfatório relativamente aos avanços em matéria de direitos humanos

no continente europeu.

Entre os desenvolvimentos positivos, recordou a importante mobilização contra o extremismo violento e o

terrorismo, após os ataques contra o Charlie Hebdo, nomeadamente o lançamento da Aliança Parlamentar

contra o Ódio, para a qual se sentiu particularmente honrada por obter o apoio do Papa, a proclamação de uma

Jornada Europeia para as vítimas dos crimes de ódio ou ainda, com a entrada em vigor da Convenção de

Istambul, sobre a prevenção e a luta contra a violência doméstica e a violência contra as crianças.

Concluiu ainda, que para responder a todos os obstáculos que tem de enfrentar, a Assembleia Parlamentar

deve permanecer unida. Cada voz é importante. Cada ação levada a cabo, quer no seio dos parlamentos

nacionais, quer au nível europeu e internacional têm a maior importância. Constatou a extraordinária mobilização

da Assembleia, durante os dois últimos anos, cada vez que esses mesmos valores eram contestados. Graças

aos esforços e compromissos comuns, a Assembleia conseguiu adotar posições de princípio audaciosas, de

cada vez que os princípios do Conselho da Europa foram postos em perigo.

Antes de concluir, a Presidente Anne Brasseur dirigiu os seus agradecimentos ao Presidente da Delegação

portuguesa à APCE, Deputado João Bosco Mota Amaral, por ocasião da sua última presença na Sessão,

enquanto membro da Assembleia Parlamentar, enaltecendo a sua longa e prestigiante carreira, o seu empenho

e intensa atividade enquanto membro da APCE, bem como os valiosos contributos na promoção dos objetivos

do Conselho da Europa. Agradeceu ainda a todos os colegas que já não serão membros das respetivas

delegações a partir da próxima Sessão, pelo seu trabalho e apoio.

Europa, Wojciech Sawick, para um mandato de cinco anos, com início a 1 de fevereiro de 2016, no dia

29 de setembro.

 Sua Alteza Real o Grão-Duque do Luxemburgo, dirigiu-se à Assembleia Parlamentar, no dia 29 de

setembro.

 Eleição da Juíza do Tribunal Europeu dos Direitos do Homem, Alena Polácková, em representação da

República da Eslováquia, no dia 29 de setembro.

 Intervenção do Presidente do Conselho de Ministros da Bósnia e Herzegovina, Denis Zvizdic, a 30 de

setembro.

 Debate de atualidade sobre “Uma resposta humanitária e política global à crise das migrações dos

refugiados na Europa”, com intervenções da Presidente da Câmara dos Deputados de Itália, Laura

Boldrini, e do Secretário-Geral do Conselho da Europa, Thorbjorn Jagland, no dia 29 de setembro.

 Debate conjunto – “Depois de Dublin – a necessidade urgente de um verdadeiro sistema de asilo

Europeu” e “Os países de trânsito: enfrentar os novos desafios da migração e do asilo”, no dia 29 de

setembro.

A Cerimónia da entrega do Prémio dos Direitos Humanos Václav Havel 2015, teve lugar no dia da abertura

da Sessão Plenária, tendo sido laureada Ludmilla Alexeeva, de 88 anos, eminente defensora dos direitos do

homem no seu país natal, a Rússia.

 A Reunião conjunta daNo Hate Parliamentary Alliance, teve lugar a 29 de setembro. A audição

subordinada ao tema “Os refugiados não são bem-vindos – abordagens política e mediática para a atual

crise de migrantes e refugiados” contou com a presença, da Presidente da APCE, Anne Brasseur, e da

Secretária-Geral Adjunta do Conselho da Europa, Gabriella Battaini-Dragoni, tendo como oradores

convidados, Tim Finch, ex-Diretor do Conselho para os Refugiados e Comunicações do Reino Unido, e,

Yousef Kak, médico de família, refugiado da Síria, residente em França.

O Deputado Carlos Costa Neves (PSD), Parlamentar de Referência desta Rede, em representação da AR,

não pôde participar na reunião, por razões de ordem político-parlamentar.

 A Reunião conjunta daRede dos Parlamentares de Referência da Campanha relativa à violência sexual

contra as crianças, de que a Deputada Maria de Belém Roseira (PS), é Parlamentar de Referência, e

da Comissão Assuntos Sociais, Saúde e Desenvolvimento Sustentável, teve lugar a 1 de outubro. O

Presidente da Comissão de Assuntos Sociais, Saúde e Desenvolvimento Sustentável, Valeriu Ghiletchi,

abriu a 25.ª Reunião da Rede subordinada ao tema “Proteger as crianças da violência sexual online”.

Em seguida, a Secretária-Geral Adjunta do Conselho da Europa, Gabriella Battaini-Dragoni, fez um

ponto de situação sobre a Campanha “Uma em Cinco” do Conselho da Europa.

Após uma troca de ideias sobre o tema, pela Diretora executiva do Centro de proteção das crianças online

(I-KIZ) da Alemanha, Jutta Croll, e o Responsável das políticas e das Relações Públicas, da Internet Watch

Foundation (IWF) do Reino Unido, Kristof Claesen, teve lugar um período de debate sobre o tema.

Encontros e outras cerimónias

 Teve lugar na Câmara Municipal de Estrasburgo, no dia 28 de setembro, uma cerimónia de homenagem

ao Presidente da Delegação portuguesa à APCE, Deputado João Bosco Mota Amaral, pelo Presidente

da Câmara de Estrasburgo, Roland Ries, tendo-lhe sido concedida a medalha da cidade.

 A Presidente da APCE, Anne Brasseur, recebeu o Presidente da Delegação, Deputado João Bosco

Mota Amaral, para apresentação de cumprimentos de despedida, no dia 1 de outubro.

Reunião de Secretários das Delegações Nacionais

A reunião teve lugar, a 28 de setembro, destacando-se da Ordem de Trabalhos os seguintes pontos:

 Apresentação do Projeto de Ordem de Trabalhos da Sessão Plenária (procedimentos a adotar

durante a Sessão Plenária: eleições, temas em debate, oradores, tempos de intervenção, inscrições

online, etc.).

 Próxima reunião da Comissão Permanente, Sófia, Bulgária, em 27 novembro.

 Novas medidas de segurança nas instalações do Conselho da Europa em Paris.

 Agendamento da próxima reunião de Secretários de Delegações Nacionais, para 14 de dezembro

de 2015, em Londres.

Ao longo da semana, a signatária teve diversos encontros de trabalho, com membros do Secretariado de

algumas Comissões e com Secretários de algumas Delegações Nacionais.

Realça-se ainda o excelente apoio da Missão Permanente junto do Conselho da Europa, nomeadamente do

Representante Permanente, Embaixador Luís Filipe Castro Mendes e dos seus funcionários.

Madam President,

I do thank you very much for your kind words about myself, included in the introductory speech of

this Part Session.

Yes, I am leaving the Parliamentary Assembly after about twenty years of intense participation.

Previously, I have been a member of the Congress of Local and Regional Authorities of Europe,

from 1978 to 1995, in my capacity as President of the Government of the Autonomous Region of

Azores.

For almost four decades, in Strasbourg, in the Council of Europe, I got strongly committed to the

great designs of human rights, parliamentary democracy and the rule of law, on which Europe,

after the bloody horrors of World War II, has been reconstructed. I shall always remain so!

Madam Speaker

Honourable Parliamentarians,

Distinguished Guests,

Ladies and Gentlemen,

Taking the floor, in several debates, in the past few years, I have insistently called the attention of

the Assembly for the mutual implication of the European Political Model, whose main

fundamentals I just mentioned, and the European Social Model, which includes the pursuit of full

employment, decent jobs and a social security system for the working classes, in the framework

of the free market enterprise principle and the submission of economic and financial forces to the

democratic political power.

The crisis we are now facing in Europe, to which the OECD and Mr. Elzinga reports make

reference, is, in my opinion, the consequence of the dissolution of these links.

The erosion of the European Social Model, promoted by the prevailing neoliberal ideology, which

– it looks – has captured the centre and centre right and even centre left, that is social

democratic, political parties, puts at risk the European Political Model.

Globalisation is good and is providing the rise from extreme poverty for millions and millions of

men, women and children in less developped countries. Back in the Sixties of last century, we

were all complaining about the unfair distribution of wealth in the world and asking for

assistance and impulse to the Third World countries. Our demands are now fulfilled.

But globalisation needs to be regulated! Otherwise, the trace of destruction of jobs it leaves in the

industrialised countries becomes, as it is now, a dramatic problem, made even more difficult to

solve by the technological revolution, which is under way.

There is a need to globalise also human rights! Fair trade among nations should be based on

acceptable balanced common rules for the protection of labour and environment.

What we have seen so far, in many cases, is the wild exploitation of ill paid workers, sometimes

even children submitted to conditions pretty close to slavery, and the destruction of ecological

imbalances, which are right now threatening the future of mankind.

As a consequence of these disorders, aggravated by greedy financial speculation, the

accumulation of wealth and the impoverishment of the middle class is indeed shocking and

socially and politically very dangerous, in many countries around the world.

And in some countries, including member countries of the Council of Europe, we are confronted,

with the scandalous behaviours of the overprivileged technostructure of the multinational high

finance and industrial conglomerates, which act ostensibly against the law, pay billionaire fines

with resources of the corporations they chair, at the expenses of their shareholders and the taxes

dued, to avoid criminal pursuits and, at the end of the day, collect fabulous bonuses and even

manage to promote legislation to cover their wrong doings...

The influence of big money in politics is undeniable and puts in jeopardy democratic institutions.

Serious reforms must be made to correct this. In the name of the sound principles of the Council

of Europe we should not close our eyes. We must act and act now!
