PROTOCOLE N° 2 À LA CONVENTION EUROPÉENNE POUR LA PRÉVENTION DE LA TORTURE ET DES PEINES OU TRAITEMENTS INHUMAINS OU DÉGRADANTS.

Les Etats signataires du présent Protocole à la Convention européenne pour la prévention de la torture et des peines ou traitements inhumains ou dégradants, signée à Strasbourg le . 26 novembre 1987 (ci-après dénommée «la Convention»):

Convaincus de l'opportunité de permettre aux membres du Comité européen pour la prévention de la torture et des peines ou traitements inhumains ou dégradants (ci-après dénommé «le Comité») d'être rééligibles deux fois;

Considérant, en outre, la nécessité de garantir un renouvellement équilibré des membres du Comité;

sont convenus de ce qui suit:

Article 1

1 — La deuxième phrase du paragraphe 3 de l'article 5 de la Convention se lit comme suit:

«Ils sont rééligibles deux fois.»

2 — L'article 5 de la Convention est complété par des paragraphes 4 et 5 ainsi rédigés:

«4 — Afin d'assurer dans la mesure du possible le renouvellement d'une moitié du Comité tous les deux ans, le Comité des Ministres peut, avant de procéder à toute élection ultérieure, décider qu'un ou plusieurs mandats de membres à élire auront une durée autre que quatre ans sans que cette durée toutefois puisse excéder six ans ou être inférieure à deux ans.

5 — Dans le cas où il y a lieu de conférer plusieurs mandats et lorsque le Comité des Ministres fait application du paragraphe précédent, la répartition des man: dats s'opère suivant un tirage au sort effectué par le Secrétaire Général du Conseil de l'Europe, immédiatement après l'élection.»

Article 2

1 —. Le présent Protocole est ouvert à la signature des Etats signataires de la Convention ou adhérant à celle-ci, qui peuvent exprimer leur consentement à être liés par:

a) Signature sans réserve de ratification, d'acceptation ou d'approbation; ou

b) Signature sous réserve de ratification, d'acceptation ou d'approbation, suivie de ratification, d'acceptation ou d'approbation.

2 — Les instruments de ratification, d'acceptation ou d'approbation seront déposés près le Secrétaire Général du Conseil de l'Europe.
