de ratificação, em 24 de Maio de 1983, durante uma conferência de plenipotenciários realizada em Genebra, no âmbito da Agência Espacial Europeia (ESA).

2 — A referida Convenção foi ao encontro da necessidade, sentida pelos Estados membros, do estabelecimento, manutenção e exploração em comum de sistemas europeus de satélites meteorológicos operacionais, dada a particular importância que os elementos de informação, obtidos por aqueles meios avançados de observação, têm em sectores económicos chave da economia e a circunstância de os recursos humanos, técnicos e financeiros necessários para tal fim ultrapassarem as possibilidades individuais de cada um dos países europeus.

3 — Portugal não poderia, pois, deixar de associar--se a esta empresa europeia. A participação na EUMETSAT, associação de tipo cooperativo, comportará inegáveis vantagens para o nosso país, que, sem contrapartidas financeiras de maior peso, terá acesso aos benefícios da utilização das tecnologias espaciais mais avançadas.

4 — Esse facto foi aliás determinante para que Portugal, mediante acordo assinado com a Agência Espacial Europeia, em Fevereiro de 1984, tenha participado no Programa Operacional da EUMETSAT, visando os fins acima indicados.

A entrada em vigor da Convenção, em 19 de Junho de 1986, fez caducar o referido Acordo, tornando premente a adesão plena de Portugal à EUMETSAT, por meio da ratificação da respectiva Convenção.

Nos termos da alínea d) do n.° 1 do artigo 200.° da Constituição, o Governo apresenta à Assembleia da República a seguinte proposta de resolução:

Artigo único. É aprovada para ratificação a Convenção que estabeleceu a Organização Europeia para a Exploração de Satélites Meteorológicos (EUMETSAT), concluída em Genebra, a 24 de Maio de 1983, cujo texto em inglês e a respectiva tradução para Português se anexam.

CONVENÇÃO PARA 0 ESTABELECIMENTO DE UMA ORGANIZAÇÃO EUROPEIA PARA A EXPLORAÇÃO DE SATÉLITES METEOROLÓGICOS (EUMETSAT).

The States parties to this Convention: Considering that:

The safety of populations and the efficient execution of numerous human activities are conditioned by meteorological data and that it calls for more accurate and prompter forecasts;

The possibility of improving the forecasts to a large extent depends on the availability of meteorological observations, local as well as global, including those relating to remote and desert regions;

Meteorological satellites have proved their aptitude and unique potential as a complement lo the ground observation systems, particularly in respect of permanent weather monitoring and the carrying out and speedy collection of observations over the most inaccessible areas of the earth's surface;

Noting that:

The World Meteorological Organization has recommended its members to improve meteorological data bases and strongly supported plans to develop and explc't a g'ob*>' s^'titc observation system in order to contribute to the «World Weather Watch»;

The METEOSAT experimental programme, conducted by the European Space Agency, has demonstrated Europe's capacity to assume its share of responsibility in the operation of a global satellite observation system;

Recognising that:

No national or international organization has planned any arrangement to provide Europe with all meteorological satellite data necessary lo cover its zones of interest;

The magnitude of the human, technical and financial resources required for activities in the space field is such that these resources lie beyond the means of any single European country;

It is desirable to provide the European meteorological organizations with a framework for co-operation enabling them to embark on joint activities making use of space technologies applicable to meteorological research and weather forecasting;

have agreed as follows:

ARTICLE 1 Establishment of EUMETSAT

1 — A European Organization for the Exploitation of Meteorological Satellites, hereinafter referred to as «EUMETSAT», is hereby established.

2 — The members of EUMETSAT, hereinafter referred to as «Member States», shall be those States that are Parties to this Convention in pursuance of the provisions of article 15, 2 or 3.

3 — EUMETSAT shall have legal personality. It shall in particular have the capacity to contract, to acquire and dispose of movable and immovable property and to be party to legal proceedings.

4 — The organs of EUMETSAT shall be the council and the director.

5 —The headquarters of EUMETSAT shall provisionally be located in the European Space Agency's premises in Paris. The final decision on the location of the headquarters shall be taken by the council, in accordance with the provisions of article 5, 2, b), vm)t below.

6 — The official languages of EUMETSAT shall be the English and the French.
