PROPOSTA DE RESOLUÇÃO N.2 64/VI

APROVA, PARA RATIFICAÇÃO, 0 PROTOCOLO DE ADESÃO DA REPÚBLICA HELÉNICA À UNIÃO DA EUROPA OCIDENTAL.

Nos termos da alínea d) do n.° 1 do artigo 200.° da Constituição, o Governo apresenta à Assembleia da República a seguinte proposta de resolução:

Artigo único. É aprovado, para ratificação, o Protocolo de Adesão da República Helénica à União da Europa Ocidental, concluído em Roma a 20 de Novembro de 1992, cuja versão autêntica em língua inglesa e respectiva tradução em língua portuguesa seguem em anexo à presente resolução.

PROTOCOL OF ACCESSION OF THE HELLENIC REPUBLIC TO WESTERN EUROPEAN UNION TOGETHER WITH AN ANNEX.

The High Contracting Parties to the Treaty of Economic, Social and Cultural Collaboration and Collective Self-Defence, signed at Brussels on 17th March 1948, as modified and completed by the Protocol signed at Paris on 23 October 1954 and the other Protocols and Annexes which form an integral part thereof, hereinafter referred to as «the Treaty», on the one hand, and the Hellenic Republic on the other:

Reaffirming the common destiny which binds their countries and in accordance with the undertaking to complete an European Union made at Maastricht on 7 February 1992 in the Treaty on European Union;

Convinced that the construction of an integrated Europe will remain incomplete as long as it does not include the development of a European security and defence identity;

Determined to strengthen the role of WEU, in the longer term perspective of a common defence policy within the European Union which might in time lead to a commom defence, compatible with that of the Atlantic Alliance;

Nothing that the Hellenic Republic, which is fully committed to the process of European construction and is a member of the Atlantic Alliance, has formally stated that it is prepared to accede to the Treaty;

Nothing that the Hellenic Republic accepts the agreements, decisions and rules adopted in conformity with the Treaty and the Declarations Starling with the Rome Declaration of 27 October 1984;

Nothing that the Hellenic Republic undertakes to develop WEU as the defence component of the

European Union and as the means to strengthen the European pillar of the Atlantic Alliance, in keeping with the obligation entered into on 10 December 1991 in the Declaration on the role of WEU and its relations with the European Union and with the Atlantic Alliance attached to the Treaty on European Union, and accepts in full the Petersberg Declaration, in particular its Part D3, issued on 19 June 1992;

Recalling the invitation issued on 30 June 1992 by the German Minister of Foreign Affairs and Chairman-in-Office of the Council of Western European Union to the Hellenic Republic to open discussions with a view to its possibile accession to the Treaty;

Nothing the satisfactory conclusion of the discussions which followed this invitation;

Nothing the invitation to accede to the Treaty issued to the Hellenic Republic on 20 November 1992;

Considering that the enlargement of Western European Union to include the Hellenic Republic represents a significant step in the development of the European security and defence identity;

have agreed as follows:

Article I

By the present Protocol, the Hellenic Republic accedes to the Treaty.

Article n

By its accession to the Treaty, the Hellenic Republic becomes party to the Agreements concluded between the member States, as listed in an annex to the present Protocol.

Article III

Each of the signatory States shall notify the Belgian Government of the acceptance, approval or ratification of the present Protocol, which shall enter into force on the day of the receipt of the last of these notifications. The Belgian Government shall inform the signatory States of each such notification and of the entry into force of the Protocol.

In witness whereof the undersigned, being duly authorised thereto, have signed the present Protocol.

Done at Rome, this twentieth day of November 1992 in the English and French languages both textes being equally authoritative, in a single original, which shall remain deposited in the archives of the Government of the Kingdom of Belgium, which shall transmit a certified copy to the Governments of the other signatory States.
