Article II

Without prejudice to the rights of States which are Members of NATO or participants in the Partnership for Peace but which are not Parties to the present Protocol, the Parties hereto shall apply provisions identical to those set forth in the Paris Protocol, except as modified in the present Protocol, with respect to the activities of NATO military headquarters and their military and civilian personnel carried out in the territory of a Party hereto.

Article III

1 — In addition to the area to which the Paris Protocol applies, the present Protocol shall apply to the territory of all States Parties to the present Protocol, as described in article n, paragraph 1, of the PfP SOFA.

2 — For purposes of the present Protocol, references in the Paris Protocol to the North Atlantic Treaty area shall be deemed to include the territories referred to in paragraph 1 of the present article.

Article IV

For purposes of implementing the present Protocol with respect to matters involving Partner States, provisions of the Paris Protocol that provide for differences to be referred to the North Atlantic Council shall be construed to require the Parties concerned to negotiate between or among themselves without recourse to any outside jurisdiction.

Article V

1 — The present Protocol shall be open for signature by any State that is a signatory of the PfP. SOFA.

2 — The present Protocol shall be subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Government of the United States of America, which shall notify all signatory States of each such deposit.

3 — As soon as two or more signatory States have deposited their instruments of ratification, acceptance or approval, the present Protocol shall come into force in respect of those States. It shall come into force in respect of each other signatory State on the date of the deposit of its instrument.

Article VI

The present Protocol may be denouced by any Party to this Protocol by giving written notification of denunciation to the Government of the United States of America, which will notify all signatory States of each such notification. The denunciation shall take effect one year after receipt of the notification by the Government of the United States of America. After the expiration of this period of one year, the present Protocol shall cease to be in force as regards the Party that denounces it, except for the settlement of outstanding claims that arose before the day on which the denunciation takes effect, but shall continue in force for the remaining Parties.

In witness whereof, the undersigned, being duly authorized, have signed this Protocol.

Done in Brussels, this nineteenth day of December, 1997 in the English and French languages, both texts being equally authoritative, in a single original which

shall be deposited in the Archives of the Government of the United States of America. The Government of the United States of America shall transmit certified copies thereof to ail the signatory States.

PROTOCOLE ADDITIONNEL COMPLÉMENTAIRE À LA CONVENTION ENTRE LES ÉTATS PARTIES AU TRAITÉ DE L'ATLANTIQUE NORD ET LES AUTRES ÉTATS PARTICIPANT AU PARTENARIAT POUR LA PAIX SUR LE STATUT DE LEURS FORCES.

Considérant la Convention entre les États parties au Traité de l'Atlantique Nord et les autres États participant au Partenariat pour la paix sur le statut de leurs forces et le Protocole additionnel à cette Convention, signés à Bruxelles le 19 juin 1995;

Considérant la nécessité d'établir et de réglementer le statut des quartiers généraux militaires de l'OTAN établis sur le territoire des États participant au Partenariat pour la paix et du personnel de ces quartiers généraux afin de faciliter les rapports avec les forces armées des divers pays membres du Partenariat pour la paix;

Considérant la nécessité de prévoir un statut approprié pour le personnel des forces armées des États partenaires attaché ou associé aux quartiers généraux militaires de l'OTAN;

Considérant qu'il peut être souhaitable, compte tenu des circonstances propres à certains États membres de l'OTAN ou à certains États partenaires, de répondre au besoin énoncé ci-dessus par le moyen du présent Protocole:

Les Parties au présent Protocole sont convenues de ce qui suit:

Article I .

Aux fins du présent Protocole:

1 — Par «Protocole de Paris» on entend le Protocole sur le statut des quartiers généraux militaires internationaux créés en vertu du Traité de l'Atlantique Nord, signé à Paris le 28 août 1952.

a) Par «Convention», chaque fois que ce mot figure dans le Protocole de Paris, on entend la Convention entre les États parties au Traité de l'Atlantique Nord sur le statut de leurs forces rendu applicable par la Convention entres les États parties au Traité de l'Atlantique Nord et les autres États participant au Partenariat pour la paix sur le statut de leurs forces, faite à Bruxelles le 19 juin 1995.

b) Les expressions «force» et «élément civil», chaque fois qu'elles figurent dans le Protocole de Paris, ont la signification qui leur est donnée à Particle 3 du Protocole de Paris et incluent également les personnes ressortissant d'autre États parties au présent Protocole et participant au Partenariat pour la paix, qui sont attachées ou associées aux quartiers généraux militaires de l'OTAN.

c) L'expression «personne à charge», chaque fois qu'elle figure dans le Protocole de Paris, signifie le conjoint d'un membre d'une force ou d'un élément civil définis à l'alinéa b) du présent article, ou les enfants qui sont à leur charge.

2) Par «la SOFA du PPP», chaque fois que cette expression figure dans le^ présent Protocole, oh entend la Convention entre les États parties au Traité de l'Atlantique Nord et les autres États participant au Par.-
