2 - No Código Civil: excepções à consideração dos animais como coisas

Áustria Allgemeines Bürgerliches Gesetzbuch, ABGB – Código Civil Austríaco Artigo 285aº Os animais não são coisas; estes são protegidos mediante leis especiais. As normas relativas às coisas são aplicáveis aos animais, na medida em que não existam disposições divergentes.
Artigo 1332aº No caso de um animal ser ferido, são reembolsáveis as despesas efectivas com o seu tratamento mesmo que excedam o valor do animal, na medida em que um dono de animal razoável, colocado na situação do lesado, também tivesse realizado essas despesas.

Artigo 251.º (1) To the extent that restoration is not possible or is not sufficient to compensate the obligee, the person liable in damages must compensate the obligee in money.
(2) The person liable in damages may compensate the obligee in money if restoration is only possible with disproportionate expenses. Expenses incurred as a result of the curative treatment of an injured animal are not disproportionate merely because they significantly exceed the value of the animal.
Artigo 833.º If a human being is killed by an animal or if the body or the health of a human being is injured by an animal or a thing is damaged by an animal, then the person who keeps the animal is liable to compensate the injured person for the damage arising from this. Liability in damages does not apply if the damage is caused by a domestic animal intended to serve the occupation, economic activity or subsistence of the keeper of the animal and either the keeper of the animal in supervising the animal has exercised reasonable care or the damage would also have occurred even if this care had been exercised.
Artigo 834.º A person who by contract assumes the supervision of an animal for the keeper of the animal is responsible for the damage inflicted by the animal on a third party in the manner specified in section 833.
