PROTOCOLE N° 1 A LA CONVENTION EUROPÉENNE POUR LA PRÉVENTION OE LA TORTURE ET DES PEINES OU TRAITEMENTS INHUMAINS OU DÉGRADANTS.

Les Etats membres du Conseil de l'Europe, signataires du présent Protocole à la Convention européenne pour la prévention de la torture et des peines ou traitements inhumains ou dégradants, signée à Strasbourg le 26 novembre 1987 (ci-après dénommée «la Convention»):

Considérant qu'il est opportun de permettre aux Etats non membres du Conseil de l'Europe d'adhérer, sur invitation du Comité des Ministres, à la Convention;

sont convenus de ce qui suit:

• Article 1

Le paragraphe 1 de l'article 5 de la Convention est complété par un alinéa ainsi rédigé:

«En cas d'élection d'un membre du Comité au titre d'un Etat non membre du Conseil de l'Europe, le Bureau de l'Assemblée Consultative invite le parlement de l'Etat concerné à présenter trois candidats, dont deux au moins seront de sa nationalité. L'élection par le Comité des Ministres aura lieu après consultation de la Partie concernée.»

Article 2

L'article 12 de la Convention se lit comme suit:

«Chaque année, le Comité soumet au Comité des Ministres, en tenant compte des règles de confidentialité prévues à l'article 11, un rapport général sut ces activités^ qui est transmis à l'Assemblée Consultative, ainsi qu'à tout Etat non membre du Conseil de l'Europe partie à la Convention, et rendu public.»
