The maximum value for each Lot of the framework contract will be set in the contract award decision.

The LCA may adjust the individual quota allocated to the PCA in view of its actual consumption. Unless otherwise agreed, the LCA may redistribute the yearly unused PCA quota to the LCA or another PCA after each completed year. The PCAs will indicate their needs to increase or decrease their respective quota to the LCA. The PCAs acknowledge that a quota increase may not be automatically granted. A quota decrease shall not be the basis for any financial claims on the PCA or the LCA.

3.3. Preparation of the procurement documents The LCA and the PCA commit to ensure confidentiality of all documents exchanged in preparation of the procedure and during the procedure.

The LCA will draft all necessary documents necessary for carrying out the procedure and will make the draft procurement documents available to the PCA.

The PCA may propose changes to the draft procurement documents, notably in relation to the technical specifications, and Contracting Authorities will discuss to find a mutually agreeable solution. The LCA sends the final procurement documents to the PCA.

Should the PCA not agree with the final version of the procurement documents, it may decide not to participate in the joint procurement procedure.

The law applicable to the framework contract to be concluded on the basis of the joint procurement will be European Union law complemented by the law of Belgium. The court competent for hearing disputes relating to the framework contract will be the General Court of the Court of Justice of the European Union.

The law applicable to orders concluded by the PCA will be subject to the national law of the respective Member State.

4. Procurement Procedure

The LCA: • Acts as a single contact point throughout the procedure for economic operators as well as

for Contracting Authorities.
