b) To supply information which is not obtainable under the laws or in the normal course of the administration of that or of the other Contracting State;

c) To supply information which would disclose any trade, business, industrial, commercial or professional secret or trade process, or information, the disclosure of which would be contrary to public policy (ordre public).

Article 27

Members of diplomatic missions and consular posts

Nothing in this Convention shall affect the fiscal privileges of members of diplomatic missions and consular posts under the general rules of international law or under the provisions of special agreements.

CHAPTER VI Firfal provisions

Article 28 Entry into force

1 — This Convention shall be ratified and the instruments of ratification shall be exchanged at ... as soon as possible.

2 — The Convention shall enter into force upon the exchange of instruments of ratification and its provisions shall have effect:

a) In respect of taxes withheld at source, the fact giving rise to them appearing on or after the first day of January of the year next following the year in which this Convention enters into force; and

6) In respect of other taxes as to income arising in any fiscal year beginning on or after the first day of January in the year next following the year in which this Convention enters into force.

Article 29 Termination

This Convention shall remain in force until terminated by a Contracting State. Either Contracting State may terminate the Convention, through diplomatic channels, by giving notice of termination at least six months before the end of any calendar year following after the period of five years from the date on which the Convention enters into force. In such event the Convention shall cease to have effect:

a) In respect of taxes withheld at source, the fact giving rise to them appearing on or after the first day of January in the year next following the date on which the period specified in the said notice of termination expires; and

b) In respect of other taxes as to income arising in the fiscal year beginning on or after the first day of January in the year next following the date on which the period specified in the said notice of termination expires.

In witness whereof the undersigned, duly authorized thereto, have signed this Convention.

Done at Lisbon, on 9th May of 1995, in two originals, each in the English, Portuguese and Polish languages,

the three texts being equally authentic. In case of any divergence of interpretation, the English text shall prevail.

APROVA, PARA RATIFICAÇÃO, 0 ACORDO ENTRE 0 MINISTÉRIO OA DEFESA NACIONAL DA REPÚBLICA PORTUGUESA E 0 MINISTÉRIO DA DEFESA NACIONAL DA REPÚBLICA DA POLÓNIA EM MATÉRIA OE COOPERAÇÃO BILATERAL NO DOMÍNIO MILITAR, ASSINADO EM VARSÓVIA EM 12 DE JULHO DE 1995.

A Assembleia da República resolve, nos termos dos artigos 164.°, alínea j), e 169.°, n.° 5, da Constituição, aprovar, para ratificação, o Acordo entre o Ministério da Defesa Nacional de Portugal e o Ministério da Defesa Nacional da Polónia em Matéria de Cooperação Bilateral no Domínio Militar, assinado em Varsóvia, em 12 de Julho de 1995, cujas versões autênticas nas línguas portuguesa, polaca e inglesa seguem em anexo.

Aprovada em 22 de Maio de 1997.

ACORDO ENTRE 0 MINISTÉRIO DA DEFESA NACIONAL DA REPÚBLICA PORTUGUESA E 0 MINISTÉRIO DA DEFESA NACIONAL DA REPÚBLICA DA POLÓNIA EM MATÉRIA DE COOPERAÇÃO BILATERAL NO DOMÍNIO MILITAR.

O Ministério da Defesa Nacional de Portugal e o Ministério da Defesa Nacional da Polónia, adiante designados por «Partes»:

Guiados pelos princípios da Acta Final da Conferência de Segurança e Cooperação na Europa, a Carta de Paris para Uma Nova Europa, e o Documento de Viena de 1994, o Tratado sobre Forças Convencionais na Europa, assim como outros acordos internacionais no domínio da segurança e das medidas de criação de confiança;

Desejando desenvolver e fortalecer a cooperação bilateral no domínio da defesa, incluindo contactos militares entre as Forças Armadas da República Portuguesa e da República Polaca;

Convictos de que a cooperação bilateral e os contactos militares entre ambas as Partes contribuem para o fortalecimento da confiança mútua e a consolidação da segurança ná Europa e no mundo;

decidiram o seguinte:

As Partes manterão e desenvolverão a cooperação bilateral no domínio militar em áreas de mútuo interesse
