own territory, catering at the place of activity, as basic well as medical services in emergency cases;

b) The sending Party will bear the expenses for international transportation and any other expenses, except the above mentioned.

Article 6

The provisions of this Agreement will be executed between the Parties, according to legislation of the country and in observation of the rules of international law.

Article 7

Any divergence about the interpretation of the clauses of this Agreement will be solved by the Parties as soon as possible, through consultations within the Commission.

Article 8

This Agreement will not affect the commitments resulting for each Party from other international agreements in which they are Parties too, and is not directed against the security and the territorial integrity of other states.

Article 9

Whenever one of the Parties is unable to comply with the provisions of this Agrement or wants to propose amendments or changes, the Parties will begin consultations within the Commission, in order to solve the problem.

Article 10

1 — This Agreement shall be of unlimited duration.

2 — This Agreement may be terminated by either Party; in such case, it will cease to apply after six months upon the receipt by either Party of a written notice of termination from the other Party.

3 — This Agreement will enter into force when the Parties notify each other of the accomplishment of the required formalities of both Parties constitucional law.

Done in Warsaw, on the 12th of July 1995, in duplicate in the Portuguese, Polish and English languages, each version being equally authentic.

Incase of any divergences on interpretation of this Agreement, it will be judged in accordance with the English version.

PROPOSTA DE RESOLUÇÃO N.° 63/VII

APROVA, PARA RATIFICAÇÃO, 0 ACORDO PARA A CRIAÇÃO DO INSTITUTO INTERNACIONAL PARA A DEMOCRACIA E ASSISTÊNCIA ELEITORAL, ASSINADO EM ESTOCOLMO EM 27 DE FEVEREIRO DE 1996.

Nos termos da alínea d) do n.° 1 do artigo 200.° da Constituição, o Governo apresenta à Assembleia da República a seguinte proposta de resolução:

Ê aprovado, para ratificação, o Acordo para a Criação do Instituto Internacional para a Democracia Eleitoraj,

assinado em Estocolmo em 27 de Fevereiro de 1996, cujas versões autênticas nas línguas portuguesa e inglesa seguem em anexo.

ACORDO PARA A CRIAÇÃO DO INSTITUTO INTERNACIONAL PARA A DEMOCRACIA E ASSISTÊNCIA ELEITORAL

As Partes signatárias do presente Acordo:

Constatando que os conceitos de democracia, pluralismo e eleições livres e justas se estão a enraizar a nível mundial;

Constatando que a democracia é essencial para a promoção e garantia dos direitos do homem e que a participação na vida política, incluindo no governo, faz parte dos direitos do homem, proclamados e garantidos por tratados e declarações internacionais;

Constatando também que as noções de democracia sustentada, boa governação, responsabilização e transparência se tornaram fulcrais para as políticas de desenvolvimento nacional e internacional;

Reconhecendo que o reforço das instituições democráticas, a nível nacional, regional e global, conduz à diplomacia preventiva, promovendo assim a criação de uma melhor ordem mundial;

Compreendendo que os processos democrático e eleitoral requerem continuidade e uma perspectiva de longo prazo;

Desejando promover e implementar normas, valores e práticas universalmente aceites;

Cientes de que o pluralismo pressupõe actores e organizações nacionais e internacionais com tarefas diferenciadas e mandatos que não podem ser desempenhados por outros;

Apercebendo-se de que um local de reunião para todas as pessoas envolvidas no processo ajudaria e promoveria o profissionalismo e a criação de capacidade sistemática de realização;

Considerando que é necessário, neste domínio, um instituto internacional complementar:

acordaram no seguinte:

Artigo 1.° Criação, localização e estatuto

1 — As Partes no presente Acordo criam, por este meio, o Instituto Internacional para a Democracia e Assistência Eleitoral, como uma organização internacional, daqui em diante designado por Instituto ou IDEA.

2 — A sede do Instituto será em Estocolmo, excepto se o Conselho decidir reinstalar o Instituto noutro local. O Instituto pode criar gabinetes noutros locais, se tal se justificar para apoio dos seus programas.

3 — O IDEA terá personalidade jurídica e gozará da capacidade necessária ao exercício das suas funções e
