Section 9

The privileges and immunities for which provision is made in this Agreement are granted solely for the purpose of carrying out effectively the aims and purposes of the United Nations. The High Commissioner may waive the immunity of any staff member whenever in his opinion such immunity would impede the course of justice and can be waived without prejudice to the interests of his office.

Section 10

Without prejudice to the privileges and immunities accorded by this Agreement, it is the duty of all persons enjoying such privileges and immunities to respect the laws and regulations of Portugal.

ARTICLE V General provisions Section 11

The provisions of the General Convention on privileges and immunities of the United Nations adopted by the General Assembly of the United Nations on 13 February 1946 shall fully apply to the UNHCR Branch Office, and the provisions of this Agreement shall be complementary to those of the General Convention. In so far as any provision of this Agreement and any provision of the General Convention relate to the same subject matter, the two provisions shall, where possible, be treated as complementary, so that both provisions shall be applicable and neither shall narrow the effect of the other.

Section 12

This Agreement shall be constructed in the ligth of its primary purpose of enabling the UNHCR Branch Office in Portugal fully and efficiently to discharge its responsibilities and fulfill its purposes.

Section 13

Consultations with respect to modifications of this Agreement shall be entered into at the request of either party; any such modification shall be by mutual consent.

Section 14

This Agreement shall cease to be in force:

i) By mutual consent of both parties; or it) If the UNHCR Branch Office is removed from the territory of Portugal, except for such provisions as may be applicable in connexion with the orderly termination of the operations of the UNHCR in Portugal and the disposal of its property therein.

Section 15

This Agreement snail enter into force from the date of its signature by both parties.

Acordo entre o Governo Português e o Alto--Comissário das Nações Unidas para os Refugiados, referente à representação do ACNUR em Portugal.

O Governo Português e o Alto-Comissário das Nações Unidas para os Refugiados:

Considerando que o Governo Português (que passará a ser designado por «o Governo») e o Alto--Comissário das Nações Unidas para os Refugiados (que passará a ser designado por «o Alto-Comissário» ou «ACNUR») acordaram na abertura de uma delegação chefiada pelo representante do ACNUR (que passará a ser designada por «Delegação do ACNUR») em Lisboa e considerando que o Governo se compromete a prestar assistência ao ACNUR de forma a assegurar o seu bom funcionamento;

Considerando que a Convenção sobre Privilégios e Imunidades das Nações Unidas, adoptada pela Assembleia Geral das Nações Unidas no dia 13 de Fevereiro de 1946 (que passará a ser designada por «Convenção Geral1»), é aplicável ao ACNUR, órgão subsidiário da Assembleia Geral das Nações Unidas, segundo o artigo 22 da Carta das Nações Unidas, e, portanto, parte integrante das Nações Unidas;

Considerando a necessidade de concluir um acordo para regulamentar as questões que possam surgir do estabelecimento da delegação do ACNUR em Lisboa:

Acordaram o seguinte:

ARTIGO I Funções Secção 1

A Delegação do ACNUR exercerá as funções que lhe sejam atribuídas pelo Alto-Comissário.

ARTIGO II Estatuto da Delegação do ACNUR Secção 2

As instalações da Delegação do ACNUR e a residência do representante e do seu suplente são invioláveis.

Secção 3

As autoridades portuguesas competentes empenhar--se-ão em assegurar a segurança e a protecção das instalações da Delegação e do pessoal do ACNUR.

Secção 4

As autoridades portuguesas competentes exercerão os seus poderes no sentido de assegurar à Delegação do ACNUR o acesso aos serviços públicos necessá-
